29 CFR 1926.451(g)(1)(iv): Each employee on a self-contained adjustable scaffold shall be protected by a guardrail system (with minimum 200 pound toprail capacity) when the platform is supported by the frame structure, and by both a personal fall arrest system and a guardrail system (with minimum 200 pound toprail capacity) when the platform is supported by ropes; On July 16, 2018 at 3875 Industrial Park Road in Wabeno, the top rail of the guardrail system was not secured and failed when employee weight was applied. Employee fell thirteen feet to the lower level.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. On or before July 16, 2018 at 3875 Industrial Park Road in Wabeno, employer did not provide a means of access where the elevation to access scaffold platforms was greater than nineteen inches; employees were crossing over the top of a wall to access scaffold platforms installed on each side of the wall at thirty-six inches below the top of the wall.
