29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about July 18, 2018 the employer failed to provide personal protective equipment for extremities such as the arms of operators of the InstaPak packaging machine. Operators for this equipment utilized the hazardous chemical Instapak Component A and had exposure to the hazardous ingredient polymeric diphenylmethane diisocyanate which contains methylene bisphenyl isocyanate. These chemicals can be absorbed through the skin and lead to chemical asthma, were skin sensitizers and exposure could lead to hardening of the skin.

Hazard assessment and equipment selection. 29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. On or about July 18, 2018, the employer failed to verify and certify that the required workplace hazard assessment had been performed. Employees in the repair department and operators of the Instapak machine had exposure to hazardous chemicals that pose skin contact hazards while performing daily required activities.

29 CFR 1910.138(b): Selection. Employers shall base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified. [59 FR 16362, April 6, 1994] On or about July 18, 2018, employees with exposure to diisocyanates related to operation of the Instapak machine were provided general duty gloves. These gloves, GNRN Little Red Gripper Gloves, were of an open knit design and not designed for the prevention of skin contact from hazardous chemicals. Instapak machine operators had exposure to the hazardous chemical Instapak Component A and had exposure to the hazardous ingredient polymeric diphenylmethane diisocyanate which contained methylene bisphenyl isocyanate. These chemicals could be absorbed through the skin and lead to chemical asthma, were skin sensitizers and exposure could lead to hardening of the skin.

The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a. On or about July 18, 2018, the employer failed to develop, document and utilize machine specific energy control procedures that contained the elements in 29 CFR 1910.147(c)(4)(ii)(A) - (D) for this part. Instapak operators performed required duties related to maintenance, part replacement and component cleaning on a routine basis with exposure to stored chemical and mechanical energy sources.

29 CFR 1910.147(d) Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: 29 CFR 1910.147(d)(3): Machine or equipment isolation. All energy isolating devices that are needed to control the energy to the machine or equipment shall be physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s). On or about July 18, 2018, Instapak operators did not apply lockout/tagout energy control isolation devices in such a manner to isolate the machine from energy sources during required maintenance, repair and cleaning duties that were covered by this part. The employees were not provided and required to use devices, such as locks and hasps, to isolate equipment by applying the devices to the electrical power disconnection point for this equipment.

29 CFR 1910.1200(h): Employee information and training. 29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about July 18, 2018, the employer failed to provide information and training for employees on hazardous chemicals in the workplace. Training had not been performed to meet the requirements of 29 CFR 1910.1200(h)(3)(i)-(iv). Hazardous chemicals used in the Repair and Pack Out areas included, but were not limited to, the following hazardous chemical ingredients: polymeric diisocyanates, chlorinated hydrocarbons and halogenated hydrocarbons. Due to the use of these chemicals, employees have potential exposure to inhalation, contact and ingestion hazards associated with central nervous system effects, skin irritation, respiratory sensitivity and serious respiratory system damage.

29 CFR 1910.1200(g): Safety data sheets. 29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.) On or about July 18, 2018, the employer failed to maintain copies of the required safety data sheets for each hazardous chemical and did not provide alternative immediate employee access, such as electronic or digital access, to the required safety data sheets. The employer did not have safety data sheets available for the following hazardous chemicals: a. Stoner "Electro Kleene," used in the Repair area, contained chlorinated and halogenated hydrocarbons, has associated fire hazards related to flammability, has skin contact hazards related to irritation and central nervous system effects associated with inhalation; b. Desco Industries "Reztore ESD Surface & Mat Cleaner" used in the Repair area, contained isopropanol, has associated fire hazards related to flammability, can cause serious eye irritation and has reproductive toxic hazards; c. MicroCare, "Streak Free Glass Cleaner" used in the Repair Area, contained 2-butoxyethanol, can cause skin and eye irritation.
