29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with incident prevention; such programs shall provide for frequent and regular inspection of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about July 18, 2018 at 2602 American Drive in Appleton, employer did not conduct adequate safety inspections prior to employees working on a roof surface fifteen feet above surface level; the warning line system did not completely enclose the work area, one warning line was lying on the roof surface, and no guide lines were installed between the roof access point and work area.

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. On July 18, 2018 at 2602 American Drive in Appleton, employees were working on a roof surface without utilizing fall protection equipment; roof edge at end of parapet wall northern side twelve and one half feet above surface level and roof edge southern side fifteen feet above surface level.
