29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (Construction Reference 1926.103)     (a) Tristate Steel Fire Proofing employees', working at 350 Henry St. Brooklyn, NY 11201, were observed wearing 3M, Honeywell, and North elastomeric half-face tight-fitting respirators while spraying CAFCO Blaze-Shield II fire resistive material. The employer did not establish and implement the applicable elements of the respiratory protection program. The condition was noted on or about July 7, 2018.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103)    In the alternative  29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):   (a) Tristate Steel Fire Proofing employees', working at 350 Henry St. Brooklyn, NY 11201, were exposed to chemical hazards while spraying CAFCO Blaze-Shield II fire resistive material which contains Portland Cement, Quartz (SiO2) throughout the building. The employer did not identify and evaluate the respiratory hazard. The condition was noted on or about July 7, 2018.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

The employer did not develop and implement a maintenance and care schedule of respirators. The condition was noted on or about July 7, 2018.
