29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter (Construction Reference 29 CFR 1926.103(a) and 29 CFR 1926.1153(e)(1)):    a) On or about July 19, 2018, an employee required to wear dust masks and a half mask cartridge respirator during certain work tasks was last fit tested on March 12, 2017.

29 CFR 1926.1153(i)(1): Communication of respirable crystalline silica hazards to employees-Hazard communication. The employer shall include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200). The employer shall ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section. The employer shall ensure that at least the following hazards are addressed: Cancer, lung effects, immune system effects, and kidney effects:  a) On or about July 19, 2018, the employer had not provided training on the hazards of respirable crystalline silica to their employees.  Effective hazard communication training on respirable crystalline silica includes, but is not limited, the following: 1) Training on the health hazards associated with exposure to respirable crystalline silica. 2) Explaining which tasks in the workplace that could result in exposure to respirable crystalline silica. 3) Explain when and where employee monitoring has been conducted and what the results were. 4) Explaining what specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and when respirators are recommended. 5) Where a copy of 29 CFR 1910.1053 is readily available in the workplace. 6) What the contents of 29 CFR 1910.1054 are. 7) The purpose and a description of the medical surveillance program required by paragraph (i) of 29 CFR 1910.1053 and when the employer must offer employee medical surveillance.
