OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection and crushing hazards from operating powered industrial trucks: a) Production Area: Employees were exposed to ejection and crushing hazards while operating the Toyota #5 (model number 8FGU25) propane forklift which was not equipped with an operator restraint device (seatbelt) as observed on or about July 20, 2018. CORRECTED DURING INSPECTION.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly: a) Production Area- Employees operated propane forklifts with a front-end attached manlift cage which weighed about 290 pounds without the manufacturer's prior written approval, exposing employees to struck-by and fall hazards created by the modifications to the powered industrial truck's lifting capacity and center of gravity, as observed on or about July 20, 2018. ABATEMENT CERTIFICATION REQUIRED FOR THIS VIOLATION.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered. a) Production Area- Employees operated propane forklifts with a front-end attached manlift cage which weighed about 290 pounds. The forklift lacked allowable attachment markings which exposed employees to fall hazards and struck-by hazards due to the unknown modifications to the forklift's lifting capacity and center of gravity created by the use of a front-end attachment, as observed on or about July 20, 2018. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.1200(h)(3)(iv): Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information: a) At the facility: Employees worked with hazardous chemicals, including, but not limited to, chemicals such as CT Low VOC Acrylic modified paints and solvent such as methyl ethyl ketone, and the employer did not provide these employees with the required training on the new label elements and safety data sheet format as required by the revised OSHA Hazard Communication Standard incorporating the Globally Harmonized System of Classification and Labeling of Chemicals prior to the effective date of December 1, 2013, as observed on or about July 20, 2018. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.
