29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) Emilios Construction LLC located at 9110 Cross Creek Drive, Fort Collins, CO 80528: On and preceding 7/21/2018, the employer did not ensure that an evaluation of each powered industrial truck operator's performance was conducted at least once every three years. Three employees were moving a wall in place on the second story of a new construction home approximately 10' above the lower level. A rough terrain forklift was used by the foreman to hoist materials onto this level for the employees to use. The employer did not conduct an evaluation of this operator's performance within the past 3 years. This exposed employees to potential struck-by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Emilios Construction LLC located at 9110 Cross Creek Drive, Fort Collins, CO 80528: On and preceding 7/21/2018, the employer did not ensure that employees engaged in residential framing on the second level of a two story home were protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure. Three employees were moving a wall into place on the second story of a new construction home approximately 10' above the lower level. Two of the sides of this second level landing were open. This condition exposed employees to fall hazards of approximately 10' from the second level to the ground.
