29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    (a)Core Construction Inc. at 5010 North 9th Avenue, Sioux Falls, SD 57103: On or about and at times prior to July 17, 2018, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment conducted by a competent person. Employees were conducting steel roofing installation without a fall protection system. This condition exposed employees to a fall hazard of approximately 23 feet.       Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a)Core Construction Inc. at 5010 North 9th Avenue, Sioux Falls, SD 57103: On or about and at times prior to July 17, 2018, the exposing employer did not ensure all forklift operators were trained in operation of powered  industrial trucks in that, the operators were not trained in the use of the Ingersoll-Rand, model # VR-642C rough terrain forklift prior to its use. This condition exposed the employees to the hazard of improper forklift operation.      Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.

29 CFR 1926.760(a)(1): Each employee engaged in steel erection activity who is on a walking/ working surface with an unprotected side or edge more than 15 feet above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems:    (a)Core Construction Inc. at 5010 North 9th Avenue, Sioux Falls, SD 57103:  On or about and at times prior to July 17, 2018, the exposing employer did not ensure employees were protected from injury in that, two employees were installing steel roofing material on a commercial building and were not utilizing a fall protection system. Employees were exposed to fall hazards associated with the perimeter's edge of the roof. This condition exposed employees to a fall hazard of approximately 23 feet to the ground below.

29 CFR 1926.761(b): The employer did not instruct each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program:   (a)Core Construction Inc. at 5010 North 9th Avenue, Sioux Falls, SD 57103: On or about and at times prior to July 17, 2018, the exposing employer did not ensure that each employee engaged in steel roofing installation on a commercial building under construction, were not trained on fall hazard identification, recognition and methods to guard against falling. The condition exposed employees to the hazard of falling from an elevation of approximately 23 feet.   Abatement Note: The following provisions supplement the requirements of 29 CFR 1926.21 regarding the hazards addressed in this subpart.     (a)  Training personnel. Training required by this section shall be provided by a qualified person(s).     (b)  Fall hazard training. The employer shall provide a training program for all employees exposed to fall hazards. The program shall include training and instruction in the following areas:     1)      The recognition and identification of fall hazards in the work area;  2)      The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used;  3)      The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  4)      The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and  5)      The fall protection requirements of this subpart.     (c) A qualified person means one who, by possession of a recognized degree, certificate, or professional standing, or who by extensive knowledge, training, and experience, has successfully demonstrated the ability to solve or resolve problems relating to the subject matter, the work, or the project.
