29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:    a)  Quality Stucco Stone & Painting Located at 2251 Yearling Drive, Fort Collins, CO 80525:  On and preceding July 21, 2018, the employer did not ensure that an employee working on a JLG 600S telescoping aerial lift was attached to the boom or basket.  An employee operating this JLG lift was moving it into place to begin painting, which required him to drive to a separate location and raise the basket.  The employee was not utilizing a harness and lanyard to prevent falls out of the basket.  This exposed this employee to a fall hazard of approximately 12 feet.

29 CFR 1926.501(b)(13): Each employees engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):     a)  Quality Stucco Stone & Painting Located at 2251 Yearling Drive, Fort Collins, CO 80525:  On and preceding July 21, 2018, the employer did not ensure that employees working on the entryway roof to paint the second story exterior siding and window were protected from falling.  An employee was taping off the outside trim approximately 12 feet above ground without the use of fall protection.  This condition exposed employees to fall hazards of approximately 12 feet from the roof to the ground.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet above the upper landing surface being accessed:    a)  Quality Stucco Stone & Painting Located at 2251 Yearling Drive, Fort Collins, CO 80525:  On and preceding July 21, 2018, the employer did not ensure that ladder side rails extended at least 3 feet above the upper landing surface being accessed.  An employee used an extension ladder to access the roof where the side rails were positioned only several inches above the upper landing surface.  This condition exposed employees to a fall hazard of approximately 12 feet from the roof to the ground.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a)  Quality Stucco Stone & Painting Located at 2251 Yearling Drive, Fort Collins, CO 80525:  On and preceding July 21, 2018, the employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  Painters handled paint and caulking on both the interior and exterior of residential homes.  The employer did not develop, implement, and maintain a written hazard communication program which describes how labeling, safety data sheets, and training will met.
