29 CFR 1926.251(e)(8): Synthetic web slings were not immediately removed from service if any of the following conditions specified in 1926.251(e)(8)(i) through (e)(8)(v) were present: (i) Acid or caustic burns; (ii) Melting or charring of any part of the sling surface; (iii) snags, punctures, tears, or cuts; (iv) broken or worn stitches; or (v) distortion of fittings. (a)R.C.S. Construction Inc. at 6000 Reservoir Road, Rapid City, SD 57701: On or about and at times prior to July 19, 2018, the exposing employer did not ensure that a synthetic web sling that was being used to hoist 1200 pound sewer pipe into an excavation was properly inspected and removed from service when damage to the Liftex polyester sling, serial #1142067, was identified. This condition exposed employees to struck-by hazards associated with rigging failure.

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: (a)R.C.S. Construction Inc. at 6000 Reservoir Road, Rapid City, SD 57701: On or about and at times prior to July 19, 2018, the exposing employer did not ensure that employees were protected from potential cave-in hazards associated with safe means of access to the double stacked shielding system within the excavation. Employees had to walk down into the excavation and then utilize the ladder that was attached to the trench box to gain access. This condition exposed employees to cave-in hazards associated with accessing the trench protective system.

(a)R.C.S. Construction Inc. at 6000 Reservoir Road, Rapid City, SD 57701: On or about and at times prior to July 19, 2018 the employer did not ensure that tabulated data for the trench shields being used at the site were available. The top trench box of a double stacked trench shield system were being used in an open excavation approximately 20 feet deep were the upper box did not have associated tabulated data. This condition exposed employees to potential struck-by hazards associated with lateral displacement regarding improper installation and use of the trench box.

Construction, Inc. at 6000 Reservoir Road, Rapid City, SD 57701: On or about and at times prior to July 19, 2018, the exposing employer did not ensure that the portable extension ladder being used by employees to enter and exit a manhole was properly adjusted to allow for at least three feet of length above the upper landing surface. This condition exposed employees to an 18-foot fall hazard within the manhole.
