29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: Trench, 1 Nursery Lane, Fitchburg, Massachusetts; On or about July 23, 2018, two employees working inside a trench approximately 9 feet deep were not provided a safe means of egress from the trench. a. No ladder was in the trench to provide egress - the ladder on site was damaged and too short for the trench. b. The ramp provided was greater than a slope of 1:1.5 for type C soil and employees required assistance to climb out of the trench.

Inspections were not performed by a competent person after each rainstorm to ensure the trench was safe from cave in hazards.
