29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)TNT Homes & Construction LLC at 3640 Black Powder Road, Rapid City, SD 57703: On or about and at times prior to July 19, 2018, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were exposed to fall hazards while conducting framing operations on a single family under construction. The condition exposed subcontractor employees to a fall hazard between 10 and 19 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a)TNT Homes and Construction LLC at 3640 Black Powder Road, Rapid City, SD 57703: On or about and at times prior to July 19, 2018 the employer did not ensure employees or subcontract employees were properly trained in the recognition and avoidance of unsafe conditions applicable to their work environment. The employer did not effectively instruct employees and subcontractor employees in identifying hazards associated with residential construction to include, fall protection, ladder safety, and PPE regarding the construction of a single family home. The condition exposed employees and subcontractor employees to a fall hazard of approximately between 10 and 19 feet, falls from ladders and PPE requirements.
