29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)M3C3 LLC at 3134 Elderberry Road, Rapid City, SD 57703: On or about and at times prior to July 19, 2018, the exposing employer did not ensure employees that were working from heights on a single family home under construction were protected from falls. An employee was engaged in framing operations while working from the top plate of a framed wall. This condition exposed employees to a fall hazard of 9 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) M3C3 LLC at 3134 Elderberry Road, Rapid City, SD 57703: On or about and at times prior to July 19, 2018, the employer did not ensure that each employee engaged in framing operations on a residential project, had been trained to recognize the hazards associated with working at elevations over 6 feet. Employees working on site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 9 feet.
