29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following:     A.  Guardrail systems;  B.  Safety net systems or  C.  Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:    Drain Rack, Yard Area.  On or about July 24, 2018, employees who drained fluids from vehicles while working on the upper rack platform were exposed to falling approximately 6 feet from the side of the platform to the ground below through the holes in the middle of the platform when not covered by the vehicle (e.g., in front of the vehicle).        Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.28(b)(11)(ii): The employer did not ensure that each flight of stairs having at least 3 treads and at least 4 risers was equipped with a stair rail system.    Drain Rack Access Stairs, Yard Area.  On or about July 24, 2018, employees were exposed to fall hazards due to a missing mid rail on the left side of the stairs when descending, and a missing top rail and mid rail on the right side of the stairs when descending.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):     Entire Facility.  On or about July 24, 2018, the employer did not ensure that each employee authorized to operate a powered industrial truck, including end loaders and skid steers equipped with forks, had successfully completed training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee) and an evaluation of the operator's performance in the workplace (driving test).  Employees were exposed to crushing and struck-by hazards.       Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR 1910.178(p)(1): Powered industrial trucks found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition.    Yard Area, Hyundai End Loader, Model #HL 757-9 TM.  On or about July 24, 2018, employees operated the Hyundai end loader with a cracked windshield.  Although use of the vehicle was reduced while awaiting the replacement windshield, the vehicle was not totally taken out of service.  Employees were exposed to struck-by hazards.  There is no abatement documentation or certification required for this item.
