The employees were using a 6 foot A-frame step ladder to access the level. The ladder did not reach the second floor deck, creating an approximately 4 foot break in elevation, creating a potential fall hazard.

The employees were not using fall protection and were thus exposed to fall hazards of greater than 13 feet to the ground below. The employer, Brutus Construction Inc ., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1290726, citation number 01, item number 01 and was affirmed as a final order on 04/10/2018, with respect to a workplace located at 11 Pollock Court, Berlin, NJ.
