29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  (a) K&J Construction LLC at 731 Nighthawk Circle, Louisville, CO 80027: On and before July 24, 2018, the exposing employer did not ensure a safety program was developed and implemented for the work environment, to include regular inspections made by a competent person of the job site, materials, and equipment. Approximately, four employees were conducting reroofing work next to the edge of the first and second story roofs on a two story residential home without the use of a fall protection system. This condition exposed employees to fall hazards of approximately 8.8 feet from the first story roof to the ground and approximately 9 feet from the second story roof to the first story roof, where an employee could then potentially fall from the first story roof to the ground.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  (a) K&J Construction LLC at 731 Nighthawk Circle, Louisville, CO 80027: On and before July 24, 2018, the exposing employer did not ensure that each employee engaged in reroofing work was trained to recognize the hazard of working at elevation and trained in the use of fall protection. This condition exposed approximately four employees to fall hazards of approximately 8.8 feet from the first story roof to the ground and approximately 9 feet from the second story roof to the first story roof, where an employee could then potentially fall from the first story roof to the ground.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: 1) The nature of fall hazards in the work area; 2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  4) The role of each employee in the safety monitoring system when this system is used; 5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and 7) The role of employees in fall protection plans; 8) The standards contained in this subpart.
