29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the drying area of the 1880 Gulf to Bay location, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 92.74% (89.4 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 368 minute sampling period. Zero exposure was assumed for the 112 minute period not sampled. This violation was discovered on or about August 3, 2018. b) In the drying area of the 1880 Gulf to Bay location, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 87.78% (89.0 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 287 minute sampling period. Zero exposure was assumed for the 193 minute period not sampled. This violation was discovered on or about August 3, 2018. c) In the drying area of the 1880 Gulf to Bay location, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 72.76% (87.7 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 297 minute sampling period. Zero exposure was assumed for the 183 minute period not sampled. This violation was discovered on or about August 3, 2018.
