29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) Codys Excavating, LLC at 1820 S. Holly St., Denver, CO 80222: On or before July 10, 2018 the exposing employer did not ensure that daily inspections of a trench, which was 6 feet 4 inches in depth, approximately 3.5 feet in width, and 20 feet in length, and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that the competent person did not identify that the trench had near vertical walls, water and undercut sections near the bottom. This condition exposed employees to a crushing hazard by trench wall cave-in. Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Codys Excavating, LLC at 1820 S. Holly St., Denver, CO 80222: On or before July 10, 2018 the exposing employer did not ensure that employees working inside a trench with near vertical walls were protected from cave-in, in that two employees worked inside a trench without the use of a protective system. The trench measured 6 feet 4 inches in depth, and was approximately 3.5 feet in width and 20 feet in length. One employee worked in a section of the trench which was undercut. This condition exposed employees to a crushing hazard by excavation wall cave-in.
