OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to excessive heat: a) Furnace Heat Treat Area; On or about July 21, 2018 and at times prior, employees engaged in sorting and carrying hot aluminum automotive wheels inside a metal building were exposed to the hazard of excessive heat. A Wet Bulb Globe Temperature indoor Average (WBGTI Avg.) of 28.15 degrees Celsius or 82.67 degrees Fahrenheit for an 8 hour and 2 minute sampling period was measured from employee exposure to direct heat from Eisenmann heat oven, furnaces, indirect heat from aluminum rims and ambient temperatures.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Borbet Alabama, Inc. facility: On or about July 26, 2018 and at times prior to, the employer did not ensure initial training on Hazard Communication Program was conducted for temporary agency employee(s) working at the Borbet Alabama Inc. worksite where employee were exposed to hazards including but not limited to: Aluminum metal fume and dust.
