29 CFR 1910.110(f)(2)(i): Containers in storage shall be located so as to minimize exposure to excessive temperature rise, physical damage, or tampering by unauthorized persons.    a.  On or about July 26, 2018, 5 propane cylinders for the Clark fork lift truck were observed sitting on the floor, unsecured, next to the overhead door entrance used for vehicular and foot traffic into the work site.  The employer had not ensured that the portable propane cylinders were stored securely and in a safe area to avoid being struck by vehicular traffic.

29 CFR 1910.176(b): Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse.    a.  On or about July 26, 2018 at the work site located at 43029 Industrial Park Road, Cadiz, Ohio, pallets of lawn care materials weighing approximately 2,000 pounds were stacked two tiers high in the work area.  The pallets were not stacked in a stable, blocked or interlocked manner and created a crushed by/struck by hazard for pedestrians and fork lift operators in the work area.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.    a.  On or about July 26, 2018, the Clark fork lift truck used by employees to unload received materials, to place materials in the warehouse, and to load materials for customers was missing the pedal. cover.  The Clark fork lift truck did not have a functioning headlight, back up alert, or horn. The Clark fork lift truck was the only one at the work site, and its use exposed employees to an hazards that included (but were not limited to) struck by, impalement and falls.

On or about July 26, 2018, the Clark fork lift truck used by employees to unload received materials, to place materials in the warehouse, and to load materials for customers was missing the accelerator pedal and did not have a functioning headlight, back up alert, or horn.  The employer had not ensured that the fork lift was removed from service until repairs were completed.
