29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   (a)  Jobsite:  On or about July 3rd and 4th, 2018, an employee was not wearing a hard hat while he was working in an exaction that ranged in depth of up to about 9 1/2 feet with the spoil pile.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):   (a)  Jobsite:  On or about July 3rd and 4th, 2018, an employee was working in an excavation that was not shored nor sloped.  The excavation ranged in depth up to about 9 1/2 feet (including the spoil pile).

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    (a)  Jobsite:   On or about July 3rd and 4th, 2018, the competent person on the job did not remove his employee from the hazard of working in an excavation that was not shored nor sloped.  The excavation including the spoil pile was up to about 9 1/2 feet in height.  In addition, there were no soil tests conducted to determine the Class of soil that the employee was working in.

(a)  Jobsite:  On or about July 3rd and 4th, 2018, an employee was working in an excavation and the excavated material (spoil pile) was not at least 2 feet from the edge of the excavation.  The excavation was about 9 1/2 feet in depth (including the spoil pile)
