OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush hazards while operating a forklift without wearing a seatbelt:  a) Facility; On or about July 25, 2018: the employer exposed employees to crushed-by hazards in that employees were allowed to operate a Hyster 120 forklift without wearing the seatbelt.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to workers, in that workers were exposed to excessive heat:  Lumber Storage Yard: On or about July 26, 2018, employees of Mobile Moving and Storage Co., Inc. were exposed to the hazard of excessive heat while working in direct sunlight, which produced Wet Bulb Globe Temperatures (WBGT) of 30.5 degrees Centigrade (86.9 degrees Fahrenheit)  (Heat Index of 98.4 degrees Fahrenheit), while performing moderate manual labor  consisting of restacking lumber and the employer had not developed and implemented an adequate heat-related illness prevention program.
