29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provided for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and has authorization to take prompt corrective measures to eliminate them):    (a) Excavation at the Jobsite - The project manager, who served as the competent person, operated the excavator to dig the excavation and directed three employees to enter the excavation to work.  The project manager did not protect the employees from a cave-in hazard in that the project manager did not determine the soil classification based on one manual analysis in accordance with Appendix A to Subpart P of Part 1926.  Instead, the project manager classified the soil based on the feel of the soil when dug with the excavator.  In addition, the project manager did not slope the sides of the 11- foot deep excavation, dug in Type B soil, in accordance with the slope configurations in Appendix B to Subpart P of Part 1926 - Sloping and Benching, on or about July 27, 2018.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a) Excavation at the Jobsite - Three employees worked in the excavation, dug in Type B soil, to install storm sewer piping and inlet boxes.  This excavation had a depth of 11 feet, a bottom width of 3 feet, a length of at least 25 feet, and a top width ranging from 24 to 26 feet.  The excavation did not have an adequate protective system designed in accordance with 29 CFR 1926.652(b) in that both the eastern and western walls had four-foot high vertical sides at the bottom followed by sloping rather than both the east and west walls each having a single four-foot high by four-foot wide bench at the bottom followed by 1:1 sloping, exposing employees to a cave-in hazard, on or about July 27, 2018.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
