Such machine, tool, material, or equipment was not either identified as unsafe by tagging or locking the controls to render them inoperable or was not physically removed from its place of operation:  On or about July 27, 2018, an employee was exposed to a caught-in hazard while performing foundation repair using a foundation bottle jack without a label or markings to indicate the capacity load rating.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  On or about July 27, 2018, an employee was exposed to a caught-in hazard, while performing foundation repair on a residential site that had multiple sheets of drywall stored on a rotten wood floor.
