OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: At the facility, On or about July 27, 2018, a flagger was exposed to a 'struck by hazard' when he stepped into the path of the lull that he was escorting. Among other methods, feasible and acceptable abatement methods to correct this hazard are following respondent's revised "Equipment Escort Procedure."

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition): On or about July 27, 2018, a flagger was exposed to a struck by hazard in that he was not stationed so as to be clearly visible to approaching and other road users.
