29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)61 Seaton Lane:  On or about July 26, 2018 and times prior, three employees were on the roof replacing shingles on a two story residential roof.  The employees were not utilizing a fall protection system.   The Masterbuilt Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number1252712, citation number 1, item number 1 and was affirmed as a final order on 9/29/17 with respect to a workplace located at Nitro, WV.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) 61 Seaton Lane Lower ladder: On or about July 26, 2018, employees were exposed to a fall of approximately 12 feet while using a 20 foot Werner ladder to access another ladder on the garage roof.  The ladder extended 1 1/2 feet above the edge of the roof.  b) 61 Seaton Lane Upper Ladder: On or about July 26, 2018, employees were exposed to a fall of approximately 20 feet  while using a 20 foot Werner ladder to access another ladder on the garage roof.  The ladder extended 2 1/2 feet above the edge of the roof

29 CFR 1926.1053(b)(6): Unsecured ladder(s) were used on surfaces that were not stable and level:  a) 61 Seaton Lane: On or about July 26, 2018 and times prior employees used a 20 foot Werner extension ladder on the roof of a garage to gain access to the second story roof. The garage roof had a 30 degree angle and the ladder was not secured to prevent it from falling.
