Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a fall hazard of approximately twenty-three feet and seven inches when working from an elevated pump jack scaffold platform. On or about July 27, 2018, employees installed Tyvek Homewrap to the north side of a newly built residential dwelling from an Alum-A-Pole scaffold platform that was not secured.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about July 27, 2018, on the north side of a newly built residential dwelling were employees were exposed to a fall hazard exceeding 10 feet when installing Tyvek siding from pump jack scaffolding without a personal fall arrest or guardrail system.
