29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  200 Ligon St., Norfolk, VA 23523, U.S.S. Mesa Verde: On or about July 11, 2018, and times prior thereto, an employee was exposed to noise levels in excess of the allowable 8-hour time weighted average (TWA) of 85dBA. This violation was observed on or about July 11, 2018,  a) Where noise sampling performed up to 258 minutes indicated that an employee was exposed up to an approximately 252.3 percent noise dose which is equivalent to 96.6 dBA, exposing the employee to potential hearing loss. Zero exposure was assumed for the 222 minutes not sampled.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
