29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 29 CFR 1926.59):     (a)  Worksite:  On July 31, 2018 and times prior to, employees use Sherwin Williams paint products, such as Pro Mar 200, Tuff Surface, and Pro Block Primer, which contain but not limited to, titanium dioxide, during hotel renovation activities.  The employer has not developed or implemented a written hazard communication program for employees exposed to the paint products.        ABATEMENT NOTE:  A written program shall include a description of how the criteria for the following will be met:   1.        Labeling and other forms of warnings;   2.        Safety Data Sheets;   3.        Employee information and training.        Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled.  Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and the availability of safety data sheets must also be addressed.  The written program must be made available upon request.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s): (Construction Reference 29 CFR 1926.59):    (a)  Worksite:  Worksite:  On July 31, 2018 and times prior to, employees use Sherwin Williams paint products, such as Pro Mar 200, Tuff Surface, and Pro Block Primer, which contain but not limited to, titanium dioxide, during hotel renovation activities.  The employer did not maintain copies of the safety data sheets for the paint products.     Abatement Note:  Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.

29 CFR 1910.28(b)(11)(ii): 29 CFR 1910.28(b)(11)(ii): Stairways. The employer did not ensure each flight of stairs having at least 3 treads and at least 4 risers was equipped with stair rail systems and handrails per Table D-2; stair width 44 inches (1.1 m) to 88 inches (2.2 m) and two closed sides required to have one handrail on each enclosed side:  (a)  Basement Area, Near Laundry/Housekeeping:  On August 2, 2018 and times prior, employees accessed a stairway that was 73 inches wide with 12 risers with two enclosed sides.  The stairway was only equipped with one handrail on the right hand side.
