29 CFR 1926.760(d)(1): Guardrail systems, safety net systems, personal fall arrest systems, positioning device systems and their components did not conform to the criteria as set forth in 29 CFR 1926.502. On or about July 31, 2018, the employer did not ensure the personal fall arrest system used by an employee engaged in metal decking work activities conformed with the criteria set forth in 29 CFR 1926.502(d)(16)(iii) which states the personal fall arrest system be rigged such that an employee can neither free fall more than six (6) feet, nor contact any lower level. This exposed the employee to a fall hazard.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer did not institute a training program and ensure employee participation in the program. On or about July 31, 2018, and times prior thereto, the employer did not provide a training program and ensure an employee had participated in the program prior to allowing the employee to engage in metal decking work activities. This exposed the employee to a fall greater than 15 feet to the ground below.
