29 CFR 1910.39(c)(1): Minimum elements of a fire prevention plan. A fire prevention plan must include: A list of all major fire hazards, proper handling and storage procedures for hazardous materials, potential ignition sources and their control, and the type of fire protection equipment necessary to control each major hazard (Reference 29 CFR 1910.157(b)(1)):    a) On or about July 31, 2018, the employer had not evaluated and implemented procedures to safely store, dispense and mix Magnesium Powder in areas protected by an automatic water suppression system. Magnesium Powder ignites easier in the presence of water. Highly flammable Hydrogen gas is a byproduct of mixing Magnesium Powder and water.     b) On or about July 31, 2018, the employer had not evaluated and implemented procedures for ignition source control during intra-facility transfer, weighing, dispensing and mixing of Magnesium Powder. Common methods to control ignition sources include but are not limited to: bonding and grounding of metal containers and flushing mixing cavities with inert gases prior to the addition of Magnesium Powder.    c) On or about July 31, 2018, the employer had not developed and implemented procedures in case of clothing fires involving Magnesium Powder.

29 CFR 1910.307(c)(2)(i): Equipment shall be approved not only for the class of location, but also for the ignitable or combustible properties of the specific gas, vapor, dust, or fiber that will be present: (Note to paragraph (c)(2)(i) of this section: NFPA 70, the National Electrical Code, lists or defines hazardous gases, vapors, and dusts by "Groups" characterized by their ignitable or combustible properties.)  a) On or about July 31, 2018, the Shanghai Shengli Machinery Manufacture Co., Ltd. Mixer(LHY-0.5) EX-Factory No:2013111801 (17 cubic foot mixer), in the Mixing Room, and its associated electrical system were not approved for Class 2, Division 1 operations and not approved for usage with Magnesium (Combustible Metals) Powder.  b) On or about July 31, 2018, the electronic platform scale in the Weighing Area used for weighing batch amounts of Magnesium Powder and its associated electrical system were not approved for Class 2, Division 1 operations and not approved for usage with Magnesium (Combustible Metals) Powder.

Employee training shall include at least: The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used;   a) On or about July 31, 2018, employees handling Magnesium Powder had not been trained on the methods and procedures to be utilized to minimize ignition source hazards of transporting, weighing, and dispensing into the 17 cubic foot Mixer.  b) On or about July 31, 2018, employees dispensing Magnesium Powder into the 17 cubic foot Mixer had not been trained on the methods and procedures to be utilized to inert the 17 cubic foot Mixer and prevent Magnesium Powder from being stirred up and rising above the inerting atmosphere level.  c) On or about July 31, 2018, employees handling Magnesium Powder and working near where Magnesium Powder is handled had not been trained on the methods to be utilized for a clothing fire involving Magnesium Powder.

Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    a) On or about July 31, 2018, the employer had not provided and required usage of personal protective equipment (PPE) appropriate for employees working with Magnesium Powder. Employee training shall include at least: The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area:    a) On or about July 31, 2018, employees handling Magnesium Powder had not been trained on the hazards associated with its flammability characteristics to readily ignite in the presence of any spark or flame, water and Magnesium Powder creates Hydrogen gas, and ignited Magnesium Powder can only extinguished by smothering and allowing it to cool.
