29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) At 9095 Airway Drive, The Parkside Grand, Pensacola, Florida: On or about July 31, 2018 and at times prior; the controlling employer failed to ensure subcontracted crew (Mariano Castro Silva) performing framing activties on Building 4 had and were using fall protection exposing them to a fall hazard of up to 20 feet to the ground below. b) At 9095 Airway Drive, The Parkside Grand, Pensacola, Florida: On or about July 31, 2018 and at times prior; the controlling employer failed to ensure subcontracted crew (Pablo Garcia) performing framing activties on Building 8 had and were using fall protection exposing them to a fall hazard of up to 19.1 feet to the ground below. c) At 9095 Airway Drive, The Parkside Grand, Pensacola, Florida: On or about July 31, 2018 and at times prior; the controlling employer failed to ensure subcontracted crew (Antonio Juarez) performing roofing activties on Building 9 had and were using fall protection exposing them to a fall hazard of up to 30 feet to the ground below.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to struck-by and crush hazards from operating powered industrial trucks without wearing the seatbelt: a) At 9095 Airway Drive, The Parkside Grand Bldg. 4, Pensacola, Florida: On or about July 31, 2018 and at times prior; the controlling employer failed to ensure subcontracted (Mariano Castro Silva) employees operating powered industrial trucks were wearing seatbelts exposing them employees to crush hazards. b) At 9095 Airway Drive, The Parkside Grand Bldg. 9, Pensacola, Florida: On or about July 31, 2018 and at times prior; the controlling employer failed to ensure subcontracted (Antonio Juarez) employees operating powered industrial trucks were wearing seatbelts exposing them employees to crush hazards.
