29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: a) On or about the time frame from 7/20/18 through 7/27/18, on the second floor of the Five Story Concrete section of a building under renovation at 79 Perry Street, Buffalo, NY: Temporary wood guardrails had been installed along the four sides of a rectangular hole that had been cut in the concrete floor in order to keep employees from walking into the hole(s) which were not properly covered, and falling approx. 11 ft. to the floor below. The guardrail system consisted of wood 2x 4 top rails, mid rails, and toeboards, which were nailed into wood 2x 4 vertical posts. The horizontal span of the toprail on the north side of the enclosure was 12 feet 7 inches. The horizontal span of the toprail on the south side was approx. 10 ft. The horizontal spans of the toprails on both the north and south sides exceeded the 8 foot span between vertical posts recommended for wooden guardrails in Appendix B of Subpart M of this standard. The toprail on both the north and south sides was spliced together with what appeared to be scrap lumber. Additionally, the splice on the top rail on the north side was held together with only a single screw. ABATEMENT CERTIFICATION REQUIRED
