29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway was not at least 18 inches (46 cm) wide:  location: north side of site on or about: 7/31/18  a) Employees were walking and working from the sidewall of a dumpster. The sidewall was only 4 inches wide.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access:  location: north side of site on or about:  7/31/18  a) Employees were walking/working on a dumpster sidewall. The dumpster was 6 1/2 feet above the ground. Access was from a pallet leaned up against the dumpster.   location: north side of site on or about:  7/31/18  b) An employee was walking/working on a JLG 800S aerial lift. The dumpster was 6 1/2 feet above the ground and the aerial lift was 8 feet above the ground. Access to the lift was from a pallet leaned up against the dumpster and then from the dumpster sidewall to the lift.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(iv): Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.   location: north side of site on or about: 7/31/18  a) An employee climbed on the rails of the JLG 800S aerial lift while accessing/egressing the basket.    NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

The employee was not wearing a body belt nor was a lanyard attached to the boom or basket. 29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  location: entire site on or about: 7/31/18  a) Employees were working from a dumpster sidewall and an aerial lift. The employees were not provided with scaffold safety training.    NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.  The Westchester Stucco Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.454(a)), which was contained in OSHA inspection number 1077197, citation number 1, item number 4 and was affirmed as a final order on 4/27/2016, with respect to a workplace located at 125 Spencer Place, Mamaroneck, NY 10543.
