29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Adan's Construction, LLC. at 122 Terra Vista St, Brighton, CO: On August 3, 2018, the exposing employer did not ensure that an employee was protected from injury, in that an employee conducting reroof work on the first story of a residential home was not utilizing a fall protection system when working near the edge of the roof. This condition exposed the employee to a fall hazard of approximately 11 feet 6 inches from the first floor roof to the ground.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Adan's Construction, LLC. at 122 Terra Vista St, Brighton, CO: On and before August 3, 2018 the exposing employer did not ensure that an employee, who was exposed to fall hazards, was trained to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. This condition exposed the employee to a fall hazard of approximately 11 feet 6 inches. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: 1) The nature of fall hazards in the work area; 2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 4) The role of each employee in the safety monitoring system when this system is used; 5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and 7) The role of employees in fall protection plans; 8) The standards contained in this subpart.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to the first floor landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device was not provided to assist employees in mounting and dismounting the ladder: (a) Adan's Construction, LLC. at 122 Terra Vista Rd, Brighton, CO: On August 3, 2018, the exposing employer did not ensure that a ladder, whose length did not allow the ladder side rails to extend at least 3 feet above upper landing surface being accessed, was secured at its top to a rigid support and that a grasping device was provided to assist employee in mounting and dismount the ladder. This condition exposed employees to fall hazards up to 11 feet 6 inches from the first floor roof to the ground.
