29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On Aug. 7, 2018, there were no frequent and regular inspections being performed by a competent person in that:    (a) employees were working from a tubular welded frame scaffold platform at fall heights greater than 11 feet (lower platform) and 16 feet (upper platform) above the next lower level without a fall protection system      (b) employees working from three different platforms of the tubular welded frame scaffold did not have guardrails installed on all open sides of the working platforms     (c) an employee was working from an upper level scaffold platform that had guardrails attached on only one end to the scaffold frame upright posts     (d) employees working from a tubular welded frame scaffold were using the scaffold frame for egress, or stepping between different scaffold platform levels for egress, instead of the built-in scaffold ladders on the ends of the platform

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    On Aug. 7, 2018, located throughout a commercial structure, employees were working from several platforms of a tubular welded frame scaffold that did not have guardrails installed on all open sides while not utilizing a fall protection system. Potential fall heights were measured to be greater than 11 feet and 16 feet above the next lower level.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    On Aug. 7, 2018, employees were performing work from a tubular welded frame scaffold that had not received training to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards. Potential fall heights were measured to be greater than 11 feet and 16 feet above the next lower level while not utilizing a fall protection system.
