The area where the cutting, shredding and melting of recyclable plastic materials was performed as well as the surrounding areas had explosive dust on surfaces including on the surfaces of equipment, machinery, stored materials, sheds, shelving, beams, pipes, duct work , walls, electrical fixtures. The condition was noted on or about 08/07/18. 29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) EG Plastics LLC. Two employees working at the shredder were exposed to continuous noise. Employees were exposed to 300% and 192% of the permissible daily noise exposure or an equivalent sound level of approximately 97.9dBA and 94.7dBA , respectively. Sampling period was 480 minutes. The employees did not wear hearing protection. The condition was noted at or around 08/16/18. b) EG Plastics LLC One employee working between the melter and the shredder was exposed to continuous noise. Employee was exposed to 81% of the permissible daily noise exposure or an equivalent sound level of approximately 88.47dBA . Sampling period was 399 minutes, exposure calculations include a zero increment for the unsampled period. The employee did not wear hearing protection. The condition was noted at or around 08/16/18. Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to workers, in that the workers were exposed to excessive heat: a) On or about August 2, 2018 employees who worked in the shredding and melting area, loading materials into the shredder, were exposed to the hazard of excessive heat generated by machinery and the melting process. Such exposures may lead to the development of heat related illnesses such as heat stroke, heat stress, heat exhaustion, or death. Temperature monitoring was done in the area following the incident and levels were found to exceed safe levels of exposure. The employer had not instituted controls to minimize or eliminate the hazard. On August 2, 2018 an employee suffered heat stroke.
