29 CFR 1910.180(b)(3): The employer did not ensure only designated personnel were permitted to operate a crane covered by this section: (a) Arco Concrete Inc. at 12672 Weld County Road 6 1/4, Fort Lupton, CO 80621: On or before August 7, 2018, the employer designated a truck driver to operate the Palfinger PK 10000 Crane. "Designated" means selected or assigned by the employer or the employer's representative as being qualified to perform specific duties. However, this designated person was not trained on how to perform frequent inspection of the crane. This exposes employees to struck by hazards due to operating the crane without the proper bypass equipment installed.

29 CFR 1910.180(d)(3): "Frequent inspection." Items such as the following were not inspected for defects at intervals as defined in paragraph (d)(2)(i) of this section or as specifically indicated including observation during operation for any defects which might appear between regular inspections. Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard: (a) Arco Concrete Inc. at 12672 Weld County Road 6 1/4, Fort Lupton, CO 80621: On or before August 7, 2018 the employer did not ensure that frequent inspections were being performed to inspect the safety functions of the Palfinger 10000 Truck Crane. Frequent inspections occur on daily to monthly intervals and are meant to inspect all control mechanisms for maladjustment interfering with proper operation, inspect all control mechanisms for excessive wear of components and contamination by lubricants or other foreign matter, inspect all safety devices for malfunction, and deterioration or leakage in air or hydraulic systems.

(a) Arco Concrete Inc. at 12672 Weld County Road 6 1/4, Fort Lupton, CO 80621: On or before August 7, 2018, the employer did not maintain a safety data sheet for each hazardous chemical and lubricants, flammable liquids, and combustible liquids stored in the warehouse. These chemicals include Everglass, Acetone, Acetylene, and Portland Cement. This exposes employees to chemical irritations to eyes, respiratory, and skin due to employee lack of knowledge regarding chemical hazards.
