29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At a residential construction site located at 2011 Ridge Tree Dr., Pleasant Hill, MO: Employees were exposed to harmful chemicals that could cause injuries and/or illnesses in that the employer had not developed, or implemented, a written hazard communication program. This was demonstrated at the residential construction site when 3 employees were dispensing gasoline that was used to power the  air compressor for the pneumatic nail guns.

29 CFR 1926.102(a)(1):  Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  At the residential construction site located at 2011 Ridge Tree Dr., Pleasant Hill, MO 64080:  Employees were exposed to a struck-by hazard.  Employees were exposed to injuries to the eyes and the face while using a Hitachi brand pneumatic nail gun without eye protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   At the residential construction site located at 2011 Ridge Tree Dr., Pleasant Hill, MO: Employees were exposed to fall hazards. Employee were performing roofing operations at an elevated height of 10 feet without any means of fall protection. Employees were observed working along the sides and back of the site without any personal fall protection or fall protection systems.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  At a residential construction site located at 2011 Ridge Tree Dr., Pleasant Hill, MO: Employees were exposed to fall hazards. The employer failed to protected employees from fall related hazards in that employees were not trained on recognizing fall hazards and avoidance of the unsafe conditions. This was demonstrated when employees were observed working at a height 10 feet without the use of any fall protection and were using foam seat cushions to prevent sliding.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At a residential worksite located at 2011 Ridge Tree Dr., Pleasant Hill, MO: Employees were exposed to fall hazards. The employer failed to provided safe access to an upper landing for employees. Employees were observed using a portable  extension ladder to gain access to a roof, the ladder was only placed 1 feet above the upper landing that was being accessed.
