29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   Employees are being exposed to toxic and hazardous chemicals. This was demonstrated when the employer did not fully develop or implement a written hazard communication program. Employees are directed to use a number of chemicals as part of their daily duties, which include the cleaning and sanitizing of carpets and upholstery. The program was unwritten and deficient in several areas including, but not limited to chemical labeling, employee training, and up to date safety data sheets and chemical inventory that comply with the 2012 Global Harmonized System (GHS).

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  Employees are exposed to toxic and hazardous chemicals. Containers of hazardous chemicals were not labeled as to their contents or the hazards associated with the chemicals. A variety of containers being stored in the chemical room were either missing a label, or the label was illegible to employees.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s).  Employees were exposed to toxic and or hazardous substances. The employer failed to maintain copies of safety data sheets for all of the chemicals being used by employees or stored at the facility. Of the data sheets that were maintained many were material safety data sheets (MSDS's) and were not in compliance with 1910.1200(j)(2(ii).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Employees are being exposed to toxic and hazardous chemicals. Employees have not been trained on the hazards associated with the chemicals in the workplace including, but not limited to Ultra HD. Employees experienced irritation to the eyes, mucus membranes, and breathing issues related to the use of the chemical degreaser. The employer did not train the employees on the hazards, nor provided them any information on the chemical, rather instructed employees if it bothered them to dilute the chemical.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  Employees were exposed to toxic and or hazardous substances. The employer failed to develop and implement a hazard communication program that provided employees information on the hazards associated with the chemicals that were present in the workplace. Information would have included, but not been limited to new label requirements in lime with the global harmonized system (GHS), updated safety data sheets also in line with (GHS), and information on where and how to find that information.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  Employees are being exposed to hazardous chemicals that are both corrosive or injurious. This was demonstrated when the employer did not provide employees with a eye wash station for the mobile trucks in which chemicals are mixed and dispensed from as part of their daily duties, which include the cleaning and sanitizing of carpets and upholstery. Chemicals including, but not limited to Ultra HD are dispensed directly onto carpets or upholstery in a more concentrated form for the purposes of heavy traffic areas.
