29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a. On or about August 08, 2018, located at 311 Saddle Bred Circle, Lot#5194, Marysville, Ohio, the employer did not ensure the use of eye protection while an employee was installing oriented standard board (OSB) roof sheathing using a pneumatic nail gun to the roof trusses, thereby exposing the employee to a struck by hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    a.  On or about August 08, 2018, located at 311 Saddle Bred Circle, Lot#5194, Marysville, Ohio, an employee was installing oriented strand board (OSB) sheathing to the roof trusses at the eave of the roof without being attached to a lifeline, thereby exposing the employee to a fall hazard of approximately 16 feet.

When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee.       a.  On or about August 08, 2018, located at 311 Saddle Bred Circle, Lot#5194, Marysville, Ohio, the employer did not provide proper fall protection training to the employee installing oriented strand board (OSB) roof sheathing from the trusses at the eave of a new-build residential home.  The employee was thereby exposed to a fall hazard was approximately 16 feet.
