29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:    (a)Niz Roofing at 6201 South Minnesota Avenue, Sioux Falls, SD 57103:  On or about and at times prior to August 8, 2018, the exposing employer did not ensure employees were protected from injury in that, employees were loading roofing material on a commercial building under construction and were not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 9 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)Niz Roofing at 6201 South Minnesota Avenue, Sioux Falls, SD 57103: On or about and at times prior to August 8, 2018, the exposing employer did not ensure that each employee engaged in roofing operations on a commercial property, had been trained to recognize the hazards associated with working at elevations over feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet.
