29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:    (a)East River Homes, Inc. at 502 East Kemp Avenue, Watertown SD, 57201:  On or about and at times prior to August 9, 2018, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were exposed to fall hazards while conducting roofing operations on a single-family home. This condition exposed subcontractor employees to a fall hazard of 11 feet near the access ladder and 25 feet on the rake edge of the roof near the peak.        Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    (a)East River Homes, Inc. at 502 East Kemp Avenue, Watertown SD, 57201:  On or about and at times prior to August 9, 2018, the employer did not ensure employees or subcontractor employees were properly trained in the recognition and avoidance of unsafe conditions applicable to their work environment. The employer did not effectively instruct employees and subcontractor employees in identifying hazards associated with residential construction to include, fall protection, ladder safety, and necessary PPE regarding a re-roofing project on a single family home. The condition exposed subcontractor employees to a fall hazard between 11 and 25 feet, falls from ladders and PPE requirements.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):     (a)East River Homes, Inc. at 502 East Kemp Avenue, Watertown, SD 57201:  On or about and at times prior to August 9, 2018 the controlling employer did not ensure subcontractor employees were protected from fall hazards. Subcontractor employees were engaged in re-roofing activities on a single-family home without the use of a fall protection system. This condition exposed subcontractor employees to fall hazards of 11 feet near the access ladder and 25 feet at the rake edge near the peak.
