29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Lot 4 Osceola Village, Kissimmee FL; On or about August 7, 2018, the employer exposed employees to head injuries in that employees were allowed to work underneath the bucket of an excavator which was moving dirt out of the trench they were working in without helmets for head protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section. a) Lot 4 Osceola Village, Kissimmee FL; On or about August 7, 2018 the employer exposed employees to cave-in hazards in that employees were required to work inside of a trench measuring thirteen feet deep, twenty-one feet wide, and thirty-seven feet in length that was dug in class "c" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
