29 CFR 1926.453(b)(2)(iv): Employee(s) were not standing firmly on the floor of the basket, were sitting or climbing on the edge of the basket, or were using planks, ladders, or other devices for a work position:    On or about August 7, 2018, employees were exposed to falls of various heights up to 37 feet while performing roofing activities on a commercial building located at 5445 Whipple Avenue NW, North Canton OH 44720. The employees were working from a JLG articulating lift and the employer permitted two employees to climb out of the basket to gain access to the building.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  On or about August 7, 2018, employees were exposed to falls of various heights up to 37 feet while performing roofing activities on a commercial building located at 5445 Whipple Avenue NW, North Canton OH 44720. The employer permitted employees to work from an JLG articulating lift without using a personal fall arrest system.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    On or about August 7, 2018, employees were exposed to falls of approximately 15 feet on the first level and approximately 11 feet from the second level of the roof, while performing roofing activities on a commercial building located at 5445 Whipple Avenue NW, North Canton OH 44720.  The employer did not ensure employees were using fall protection system. The employees had fall protection on but were not tied off.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:     On or about August 7, 2018, employees were exposed to falls of approximately 15 feet on the first level and approximately 11 feet from the second level of the roof, while performing roofing activities on a commercial building located at 5445 Whipple Avenue NW, North Canton OH 44720. The employees were using a portable ladder to access the second level of the roof and the employer did not ensure the ladder extended three feet above the landing area.
