On or about August 13, 2018 on the north side of Highway 82, the employer allowed an employee to stand under the boom of an excavator while it was in operation digging an excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     On or about August 13, 2018 on the north side of Highway 82, the employer allowed employees to enter the excavation at an approximate depth of 8 feet without protection such as trench boxes, benching and sloping.    Paschal Welding and Construction was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1213866, citation number 1, item number 2b and was affirmed as a final order on 05/04/2017, with respect to a workplace located at Cross Streets of CR 310 and 145, GPS N 33-03-975/W 103.00.430, Denver City, TX 79323.
