29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met(Construction Reference: 1926.59): On or about August 7, 2018, at 1221 Stanford, Coral Gables, FL 33146, the employer did not develop and implement a written hazard communication program for employees performing indoor painting operations, and who were required to work with hazardous chemicals, such as, but not limited to, Denatured Alcohol (Carcinogenic), PROMAR 200 Zero VOC Interior Latex Paint (Carcinogenic) and Stix Waterborne Bonding Primer (Carcinogenic).

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. On or about August 7, 2018, at 1221 Stanford, Coral Gables, FL 33146, the employer did not provide protective gloves and/or protective glasses for employees performing indoor painting operations, and who were required to work with hazardous chemicals, such as, but not limited to, Denatured Alcohol (Carcinogenic), PROMAR 200 Zero VOC Interior Latex Paint (Carcinogenic) and Stix Waterborne Bonding Primer (Carcinogenic).
