29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. 29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected: On or about July 27, 2018, the employer used an International - Hough PayLoader, Model 530, primarily to move and load mulch and soil, without functional brakes for approximately three (3) months prior to the opening of this inspection. The employer failed to ensure adequate daily inspections and failed to correct brake deficiencies after they were found to be in need of repair. Employees were thereby exposed to struck-by, caught-in, and caught-between hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
