OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a) Aldana's construction located at 4818 141st Ave. Thornton, CO 80602:  On and preceding 11 August 2018, the employer did not ensure that employees were protected from fall hazards while working from a the tines of a rough terrain forklift elevated more than 10 feet above ground level. Employees were unsafely elevated using a Gehl Model RS8-42 rough terrain forklift with a framer elevated approximately 15 feet securing panels using a pneumatic nail gun. This exposed the employee to falls from height.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a) Aldana's construction located at 4818 141st Ave. Thornton, CO 80602:  On and preceding 11 August 2018, the employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles to include but not limited to debris from use of pneumatic nail guns.  Employees installing framing with a pneumatic nail gun on a residential home were not utilizing eye or face protection.  This exposed the employees to struck by hazards.
