29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On Aug. 14, 2018, located on the south side of a commercial sign structure, an employee was working from a Dura-A-Lift DTS 29 bucket truck that had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work. Potential fall heights were measured to be greater than 13 feet above the concrete surface below.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On Aug. 14, 2018, located on the south side of a commercial sign structure, an employee was working from a Dura-A-Lift DTS 29 bucket truck without being attached to the boom or bucket. Potential fall heights were measured to be greater than 13 feet above the concrete surface below.
